Asset tracing
The work of finding property a judgment debtor can be made to give up — land, vehicles, bank accounts, shares, money owed to it by others — using the public registers and, where those run out, an application to the court for an inquiry.
IN PRACTICE
What it means in practice
A creditor who does not yet know what the debtor owns starts with the public registers, which disclose only part of the picture. They are searched first — land, company records, vehicles — and where they run out, or where what they show does not match what can be observed, the court may be asked to hold an inquiry, at which the debtor or a third party who knows about the debtor's property can be summoned to give evidence and produce documents. Tracing has to be done inside the time the execution itself allows, which has to be checked case by case, so assets found late may be found too late to act on.
