Proof of debt
The application a creditor files with the official receiver to be admitted in a bankruptcy, made on the prescribed form after the court's absolute receivership order is published, and, in a bankruptcy, the only way an ordinary creditor shares in what is collected; the position in a business rehabilitation is different.
IN PRACTICE
What it means in practice
The deadline runs from publication of the order, not from the day the creditor hears about the case, which is how a real and fully documented debt ends up recovering nothing. A creditor outside Thailand may be able to obtain a limited extension, but it has to be asked for. The filing sets out the debt, the evidence for it, and any security held or property of the debtor it holds — a secured creditor that does not declare its security risks losing it. After filing, the receiver investigates and the debtor or other creditors may object, so the documents attached at the outset are what decides the outcome.
