Foreign business licences

The first question is not how to get the licence but whether one is needed at all. A great many businesses are not in the schedules, and getting this wrong at the start costs a year.

What this covers

  • Analysing whether the business falls in List 1, 2 or 3 of the Act, or outside the schedules altogether
  • Applying for the Foreign Business Licence at the Department of Business Development
  • Foreign Business Certificates under the Thai-US Treaty of Amity and under free trade agreements
  • Certificates for BOI-promoted companies and operators in industrial estates
  • Reviewing the shareholding and any shareholders' agreement so that they match what was filed

How it proceeds

  1. 01

    Classify the business

    Every activity actually to be carried on in Thailand is set out and matched against the schedules.

  2. 02

    Choose the route

    A licence, a treaty certificate, a BOI promotion certificate, or a structure that does not engage the schedules at all.

  3. 03

    File and answer

    The committee may come back on technology transfer and on Thai employment.
